Help Us Amend AB 2223 for 5.4 Million CBD Wellness Consumers and Families

Hello Patients, Providers, and Consumers of Full Spectrum Hemp CBD Products,

We are incredibly saddened and alarmed to be writing this message to you. We did not believe that the California House and Senate would pass legislation banning full spectrum hemp CBD products, but they did. Now it heads to the Governor’s desk, and he intends to sign it into law. We’re here because of the bad actors that have created intoxicating Frankenstein compounds derived from hemp CBD, and exploited loopholes to sell products like Delta 8 THC, THCP, THCO, and HHC into CBD shops, gas stations, and liquor stores across America.

In California, there are over 5 million patients who depend on full spectrum hemp CBD products, and all of them will lose access to this medicine if this passes. Broad spectrum and isolate CBD products will still be allowed, and we at Bloom Hemp CBD will have to reformulate our medicines to comply with the new law. The sad fact is that patients do much better medically with full spectrum oils due to the entourage effect. Full spectrum CBD products will be allowed in the licensed dispensaries, but there are zoning restrictions and extreme taxation issues that will put good medicines out of reach for the majority of Californians. Once this passes here in the Golden State, the domino effect will wipe out full spectrum hemp CBD everywhere.

Governor Newsom is said to be ready to sign this bill, and that is why we need your immediate attention today! We’ve tried to get him to amend it to allow minimal amounts of THC in the hemp CBD products, but fear he will not. There are ways to close the loopholes and common sense must prevail to promote safety against unnatural compounds, and safe access to natural wellness.

In attempting to address one issue, the inadvertent outcome would be the creation of 5.4 million new problems by neglecting to safeguard access for families, veterans, seniors, and countless consumers reliant on full-spectrum hemp goods for their well-being.

The THC limits in the bill are arbitrary. Particularly, the proposed definition of “Hemp Final Form Product” is excessively restrictive and disregards the benefits of various non-intoxicating cannabinoids. The suggested wording would restrict hemp products, like tinctures, to 0.25 mg THC per serving or 1 mg THC per package, potentially erasing access to the full spectrum of hemp products currently on the market. This surpasses the scope of the federal 2018 Farm Bill, which allows hemp products to contain trace amounts of other plant compounds, including naturally occurring Delta 9 THC at levels below 0.3%, which is normal for full spectrum oil.

A straightforward fix is at hand. I implore you to revise the suggested definition of “Hemp Final Form Product” in AB 2223 to encompass more moderate THC restrictions, thus safeguarding the availability of full spectrum CBD products in California. This adjustment, which has proven effective in Colorado and Virginia, is paramount for maintaining consumer access and market diversity.

California consumers require a comprehensive and equitable strategy that advocates for the accessibility of safe and advantageous hemp-derived goods. This approach should also nurture innovation and economic growth within our state, instead of endangering it. Let’s not jeopardize the well-being of millions of consumers by hastily enacting legislation that overlooks their needs.
